Leases
Whether you wish to draw up a new lease, renew an existing lease or conduct a rent review our solicitors will be able to assist.
When drawing up (or renewing) a lease, there are various options and clauses we can include for you. These include providing the option to renew the lease at a later date, full insuring and repairing the lease, rent deposits, rent reviews and break clauses.
There are two types of commercial Leases available, long-term and short-term.
The long-term lease is suitable for all types of commercial properties and tends to last for three or more years. It can be used to cover the whole of a building, or maybe just part of a building or units on an estate. Where the property only covers part of the building, the Landlord will be obligated to provide the services for maintenance and repair of the common parts, structure and exterior, with the tenant agreeing to pay a service charge to cover the costs of such maintenance.
The short-term lease is suitable for all types of commercial properties
and can last from anywhere between a couple of months, to 2-3 years. A
rent review will not normally be included as the lease is considered to
be short-term.
Prices depend on for how long you wish the lease to last for and what
optional extras you require.
Sale and / or Purchase
The sale and / or purchase of a commercial property are not too dissimilar to that of a residential property. Where possible, we will try to give you a fixed quote that will not change. As with residential conveyancing, you may require further searches for your commercial conveyancing if you are buying a commercial property with a mortgage. These searches include (but are not limited to) the Local Authority Search and the Environmental Search. Other possible disbursements include Land Registry searches, Land Registry Registration Fee, Bankruptcy search and Telegraphic Transfer fee.
Also, additional elements must be taken into consideration when buying or selling a commercial property. If there is a tenant currently renting the property, then full details must be given of any tenancy or sub-tenancy. If the property is subject to VAT then this must be enclosed in the contract.
Prices depend on the amount the property sells for (in the case of a sale) or how much the property is purchased for (In the case of a purchase)
Self Invested Personal Pension Scheme (SIPPS)
We can also help you set up a Self Invested Personal Pension Scheme. This Pension scheme allows the investor more control over the scheme and where the money is invested. You can invest in stocks and shares, deposit accounts with banks and building societies and National Savings products.
You may also invest in property, providing you are part of a syndicate of at least 10 people who are not related, and if any of the investors use the property, then they have to pay a fair market value rent into the pension fund for use of the property.
